Terms and Conditions of Sale
Governing purchases made on the website PlayWoodKids.com
These Terms and Conditions of Sale (the “Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and KronoConcept LLC, a limited liability company organized under the laws of Ukraine, trading as PlayWoodKids (“Seller,” “we,” “us,” or “our”), governing all purchases of products made through the website PlayWoodKids.com (the “Site”) by customers located in the United States.
By placing an order on the Site, submitting payment, and/or providing your personal information to complete a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms in full.
If you do not agree to these Terms, please do not place an order or use the Site to purchase products.
1. Definitions
1.1 “Site” means the website located at PlayWoodKids.com, together with any related mobile applications or storefronts operated by the Seller.
1.2 “Seller” means KronoConcept LLC, the owner and operator of the PlayWoodKids brand and the Site.
1.3 “Customer” means any individual who is at least 18 years of age, or a legal entity acting through an authorized representative, who places an Order on the Site.
1.4 “Product(s)” means the handmade wooden children’s furniture, toys, and related items offered for sale on the Site.
1.5 “Order” means a request to purchase one or more Products submitted by the Customer through the Site or through other means agreed with the Seller (e.g., direct message, email).
2. General Provisions
2.1 The Seller reserves the right to update or modify these Terms at any time. The version of the Terms in effect at the time an Order is placed will govern that Order.
2.2 The Customer is responsible for reviewing these Terms before placing an Order. Continued use of the Site or submission of an Order after changes are posted constitutes acceptance of the revised Terms.
2.3 Product images, descriptions, and colors displayed on the Site are provided for illustrative purposes. Because each item is handcrafted from natural wood, minor variations in grain, color, and texture between the Product shown and the Product delivered are normal and do not constitute a defect.
3. Products and Orders
3.1 All Products are subject to availability. The Seller reserves the right to limit quantities, discontinue a Product, or decline any Order at its discretion, including where a Product is out of stock, pricing or listing errors occur, or the information provided by the Customer appears inaccurate or fraudulent.
3.2 Many Products are handmade to order. Where applicable, estimated production and shipping timelines will be communicated to the Customer at the time of order confirmation.
3.3 The Seller may contact the Customer to confirm Order details such as size, color, personalization, or engraving prior to production.
3.4 A binding contract of sale is formed once the Seller confirms acceptance of the Order (whether by automated confirmation email, direct message, or other written communication) and, where applicable, payment has been received.
4. Pricing and Payment
4.1 All prices displayed on the Site are stated in U.S. dollars (USD) unless otherwise indicated, and are exclusive of applicable sales tax, customs duties, and shipping charges unless expressly stated otherwise.
4.2 The Seller reserves the right to change prices at any time; however, the price applicable to a confirmed Order will not change after Order confirmation, except to correct a pricing error.
4.3 Payment may be made using the methods indicated on the Site, which may include credit or debit card, third-party payment processors, or other methods made available at checkout.
4.4 For custom or made-to-order Products, the Seller may require full or partial prepayment before production begins.
4.5 The Customer is responsible for the accuracy of billing information provided and for any fees charged by their payment provider or financial institution.
5. Shipping and Delivery
5.1 Products are shipped via third-party carriers to the delivery address provided by the Customer at checkout. Estimated delivery times shown on the Site are approximate and not guaranteed.
5.2 Shipping costs, unless included in the listed price or a promotional offer, are charged separately and disclosed to the Customer prior to completion of the Order.
5.3 Risk of loss and title to Products pass to the Customer upon delivery to the carrier, except where applicable consumer protection law provides otherwise.
5.4 The Customer is responsible for any customs duties, import taxes, or other charges imposed by the destination country, where applicable. The Seller is not responsible for delays caused by customs processing.
5.5 The Customer should inspect Products promptly upon delivery and notify the Seller of any shipping damage as soon as reasonably possible, ideally with photographs of the damaged item and packaging.
6. Product Quality and Warranty
6.1 The Seller warrants that Products will substantially conform to the description provided on the Site at the time of purchase and will be free from material manufacturing defects at the time of delivery.
6.2 As noted in Section 2.3, natural variation in wood grain and finish is inherent to handmade wood products and is not considered a defect.
6.3 Except as expressly stated in these Terms, Products are provided without any other warranties, express or implied, to the fullest extent permitted by applicable law. Nothing in these Terms limits any statutory rights that cannot lawfully be excluded under the laws applicable to the Customer.
7. Returns, Refunds, and Cancellations
7.1 Unless a Product is custom-made, personalized, or otherwise noted as final sale on the Site, the Customer may request to return a Product within 14 days of delivery, provided the item is unused, in its original condition, and in its original packaging.
7.2 Custom, personalized, or made-to-order Products (including items with custom dimensions, engraving, or color selections) are generally not eligible for return or refund unless the Product arrives defective or materially not as described.
7.3 To initiate a return, the Customer must contact the Seller using the contact information provided on the Site prior to sending any item back.
7.4 Where a return is approved for a reason other than a defect or Seller error, the Customer is responsible for return shipping costs, and the original shipping charges (if any) are non-refundable.
7.5 Where a Product is defective, damaged in transit, or materially not as described, the Seller will, at its discretion, offer a repair, replacement, or refund at no additional cost to the Customer.
7.6 Approved refunds will be issued to the original payment method within a reasonable time after the returned Product is received and inspected, or after the refund is otherwise approved.
7.7 Order cancellation requests made before production has begun on a custom item will generally be honored in full. Once production has begun, cancellation may not be possible, or may be subject to a cancellation fee reflecting work already completed.
8. Customer Responsibilities
- Provide accurate and complete information necessary to process and deliver the Order.
- Ensure any personalization or customization details submitted (names, initials, dimensions, etc.) are accurate, as the Seller is not responsible for errors in information supplied by the Customer.
- Make payment in full in accordance with the agreed terms.
- Comply with these Terms and any applicable law when using the Site.
9. Limitation of Liability
9.1 To the fullest extent permitted by applicable law, the Seller’s total liability arising out of or related to an Order shall not exceed the amount paid by the Customer for the Product(s) giving rise to the claim.
9.2 To the fullest extent permitted by applicable law, the Seller shall not be liable for indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Products or the Site.
9.3 Nothing in these Terms is intended to limit any liability that cannot be limited or excluded under applicable consumer protection law, including liability for death or personal injury caused by negligence or willful misconduct.
10. Force Majeure
10.1 The Seller shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, acts of government, labor disputes, carrier delays, or disruptions to communication or logistics networks.
11. Privacy and Personal Information
11.1 By placing an Order, the Customer consents to the collection and processing of personal information (such as name, address, email, and phone number) solely for the purpose of processing, fulfilling, and communicating about the Order.
11.2 The Seller will not sell or disclose Customer personal information to third parties except as necessary to fulfill the Order (e.g., sharing a shipping address with a delivery carrier) or as required by applicable law.
11.3 Further details regarding the collection and use of personal information are set out in the Seller’s Privacy Policy, available on the Site.
12. Intellectual Property
12.1 All content on the Site, including product photography, designs, logos, and text, is the property of the Seller or its licensors and is protected by applicable intellectual property laws. Customers may not reproduce, distribute, or otherwise use such content without prior written consent.
13. Governing Law and Dispute Resolution
13.1 These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction specified in the Seller’s contact and business information on the Site, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws of the Customer’s country or state of residence apply.
13.2 The Seller encourages Customers to first contact customer support to resolve any dispute informally. If a dispute cannot be resolved informally, either party may pursue available legal remedies in accordance with applicable law.
